- Account information. When you create an account as a Customer, we collect your identity, account and log-in information, such as your first and last name, login and password details, and email address.
- Survey information. If you are a Consumer completing a Survey on our Platform, MakerSights collects certain information from you, such as your zip code, age, gender and household income. Survey responses and related information may be analyzed individually or in aggregated form in order to generate insights for our Customers and to improve our analytics systems and research methodologies.
- Communications. When you contact us, by email, through our Website or otherwise, whether as a Website visitor, Customer or Consumer, MakerSights collects personal information such as your contact details and the content of any communications you send to us. This includes communications with questions, feedback, to report a problem or to submit queries, concerns or comments regarding the Platform.
Automatic data collection
We and certain third parties, who include our service providers, advertisers, advertising networks and platforms, and third-party partners, may automatically log information about you, your computer or mobile device, your interactions over time with our Platform and our communications with you, such as:
- Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G).
- Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the Website you visited before browsing to the Platform, navigation paths between pages or screens, information about your activity on a page or screen, access times, duration of access and whether you have opened our marketing emails or clicked links within them.

Use of your Personal Information
MakerSights uses personal information for the following purposes:
- To deliver our Services. If you are a Customer, we use your personal information to deliver our Services. If you are a Consumer, it is in our legitimate interests to use your Survey information to deliver our Services.
- To communicate with Customers. We use personal information to respond to Customer requests when it is in our legitimate interests, including to provide Customer support and communicate with Customers about our Services.
- To improve our Services and keep our Platform safe. We use personal information when it is in our legitimate interests to improve our Services and keep our Platform safe.
- Research and development. We use personal information when it is in our legitimate interests to carry out research and development for our Platform and/or Services. As part of these activities, we may create or use aggregated, de-identified or otherwise anonymized data from personal information we collect.
- Marketing and advertising. We and our service providers may collect and use personal information relating to Customers when it is in our legitimate interests for the following marketing and advertising purposes:
- Direct marketing. We may send you direct marketing communications as permitted by law, including by email and text message. You may opt out of our marketing communications as described in the “Individual Rights and Choices” section below. Unless consent is required, we send direct marketing when it is in our legitimate interests.
- Interest-based advertising. It is in our legitimate interests to engage advertising partners to display ads on the internet. These companies may use cookies and similar technologies to collect information (including the automatically collected data described above) about your interactions over time on our Platform, with our communications, and with other online services, and use that information to serve online ads that they think will interest you.
- Compliance and protection. We may use personal information where it is in our legitimate interests to comply with legal obligations and to defend MakerSights against legal claims or disputes, such as to:
- Protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims).
- Audit our internal processes for compliance with legal and contractual requirements and internal policies.
- Enforce the terms and conditions that govern the Services.
- Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.
- Comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities.
- Machine Learning. We may use information for purposes of training, improving, and validating our AI learning models. Specifically, we utilize a conditional data-sharing participation model in which access to certain aggregated insights and AI-driven features is available only to users who choose to allow their own data to be used (under specified safeguards). Additionally, we may use personal information to generate aggregated insights, metrics, and similar AI-powered outputs. Users who opt out of data-sharing participation retain access to core Services but will not receive these aggregated insights or features, all as further detailed below. Where feasible, all shared data is aggregated or de-identified so that it does not reasonably identify an individual or user.
How We Disclose Your Personal Information
MakerSights may disclose personal information to:
- Customers. If you are a Consumer, we may disclose survey information (as described above) to Customers.
- Service providers. We may disclose personal information to companies and individuals that help us to operate the Platform and deliver the Services (such as hosting, information technology, customer support, email and text message delivery and website analytics services).
- Professional advisors. We may disclose personal information to professional advisors, such as lawyers, auditors, bankers, insurers and consultants, where necessary in the course of the professional services that they render to us.
- Authorities and others. We may disclose personal information to law enforcement, government authorities and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
- Business transferees. We may disclose your personal information to acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, MakerSights (including, in connection with a bankruptcy or similar proceedings).
- Advertising partners. We may disclose your personal information to third party advertising companies, including for the interest-based advertising purposes described above.
How We Use AI to Process Your Feedback
To help brands better understand your preferences, we use automated tools, including machine learning and LLMs, to process the feedback you provide. This includes quality control, analysis and summarization, grouping of data, and processing to support “digital twins” technology. You may opt-out of the use of your data for digital twin creation or automated profiling by contacting us at privacy@makersights.com. The logic used in these processes is designed to identify patterns in consumer sentiment to project market trends.
International Data Transfers
MakerSights is based in and processes personal information in the United States. We may also transfer personal information to our affiliates and service providers in the United States and other jurisdictions. Please note that such jurisdictions may not provide the same protections as the data protection laws in your home country.
When we engage in cross-border data transfers, we will ensure that relevant safeguards are in place to afford adequate protection for personal information and we will comply with applicable data protection laws, in particular by relying on an EU Commission or UK government adequacy decision/regulation for transfers outside of the European Economic Area and United Kingdom, or on contractual protections for the transfer of personal information. Use of Data in Artificial Intelligence Systems
MakerSights provides analytics and consumer insight tools that may rely on statistical modeling, machine learning, and artificial intelligence technologies.We may use personal information, survey responses, and aggregated datasets to:
- develop and train machine learning models;
- test and validate analytics methodologies;
- improve the accuracy, relevance, and performance of our Services; and
- generate predictive insights or consumer sentiment analysis for our Customers.
Where possible, MakerSights omits collecting any personal data, or failing that uses aggregated or deidentified data for these purposes. Outputs generated by these systems are intended to reflect patterns or trends in consumer feedback and are not intended to identify individual Consumers.MakerSights may be liable under the Data Privacy Framework Principles in cases of onward transfers to third parties.
Aggregated and De-Identified Data
MakerSights may aggregate or de-identify personal information so that it can no longer reasonably identify a specific individual or customer. Aggregated or de-identified data may be used to conduct research, improve our Services, train analytics models, develop new products or features, and generate statistical insights. Such information may also be shared with Customers or partners for research or benchmarking purposes.
Automated Analytics and Profiling
Our Services may use automated analytics tools to analyze consumer feedback and generate insights for Customers regarding product concepts, design preferences, or consumer sentiment. These tools use statistical and machine learning techniques to identify patterns in survey responses and related data. These systems assist our Customers in making business decisions but do not independently make decisions that produce legal or similarly significant effects concerning individual Consumers.
Transparency Regarding Customer Data
Customers may upload or provide data to the Platform in connection with their use of the Services (“Customer Data”). MakerSights processes Customer Data solely in accordance with applicable agreements with the Customer and applicable law. Customers may exclude their data from being used to develop and/or train models that may be used by other Customers which, if permitted, such data shall be aggregated and de-identified so that it no longer identifies the Customer or any individual. Customers who elect not to allow their customer Data to develop and/or train models that may be used by other Customers shall not have access to any developments or trained models resulting from other Customers shared Customer Data.
Non-Participation Path (Opt-Out of AI Model Training and Aggregated Data Sharing)
Customers may choose not to participate in data sharing for AI model training, in which case we will not use such Customer Data to train or improve our AI models in a way that contributes to aggregated insights shared with other users, except where such use is strictly necessary for:
- Providing core Services that such Customer has requested
- Ensuring security, reliability, and fraud prevention
- Complying with legal obligations
Customers who opt out of data sharing will still have access to our core Services, however, these Customers will not receive:
- Aggregated benchmarks or insights derived from the contributions of participating users
- Certain advanced AI-powered recommendations or comparative analytics that rely on the collective dataset
This is not a penalty. It is a direct consequence of the technical and conceptual nature of our model: aggregated insights are created from the collective data of participating users. If data is not included, we cannot, as a matter of design, provide those same aggregated outputs to other Customers.
Transparency About Consequences of Your Choices
If you participate in the AI data-sharing program:
- Your data (subject to de-identification and aggregation safeguards) will contribute to model training and aggregated insights.
- You will receive insights or features that depend on the pooled data of participating users.
- You may receive more tailored recommendations or analytics.
If you do not participate:
- We will not use Customer Data in AI model training for aggregated user-facing insights (except to the limited extent that is strictly necessary for core Services, security, or compliance).
- You will not have access to the specific features that depend on pooled, participating-user data.
- Your overall access to core Services will be preserved.
We will clearly label and describe which features depend on AI-based analytics and collective data so that you can make an informed choice.
Responsible AI Statement
MakerSights is committed to the responsible development and use of artificial intelligence and data analytics technologies. We implement safeguards designed to reduce risks related to bias, misuse, and unintended outcomes when developing or deploying automated systems.
Subprocessors and Service Providers
We may share personal information with service providers that perform services on our behalf, including cloud hosting providers, analytics providers, survey administration partners, and technology providers that support the operation of our Platform, including artificial intelligence infrastructure providers. These service providers are contractually required to protect personal information and use it only for the services they perform for us.
Data Retention
Where required under applicable laws, we retain personal information only for as long as is necessary to fulfill the purposes for which it was collected and processed, in accordance with our retention policies and in accordance with applicable laws and regulatory obligations. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we use personal information and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements.
Security of Your Personal Information
We use reasonable organizational, technical and administrative measures designed to protect against unauthorized access, misuse, loss, disclosure, alteration and destruction of personal information we maintain. Unfortunately, data transmission over the Internet cannot be guaranteed to be completely secure. Therefore, while we strive to protect your personal information, we cannot guarantee the security of personal information.
Job Applicants
When you apply for one of our open positions, we collect the information that you provide in connection with your job application. This includes but is not limited to business and personal contact information, professional credentials and skills, educational and work history, and other information that may be included in a resume or that you may provide during the interview process. This may also include demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information. We also collect personal information from other sources where relevant for your application, such as employment research firms, recruiters, identity verification services, and information that you make publicly available on websites or social media platforms (for example, LinkedIn or Github). Throughout the recruitment process, we may supplement your personal information in connection with the assessment of your application. For example, we may record the views of those considering your application about your suitability for the role for which you have applied and retain interview notes. If you accept an offer from us, your personal information will be incorporated into and used as part of your employee record.
Minors
MakerSights does not knowingly collect personal information from minors, the definition of which varies by jurisdiction, particularly in connection with Surveys, without express consent from a parent or guardian. If we learn that we have collected personal information from a child in violation of applicable law, we will take reasonable steps to delete such data as soon as practicable. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us as set out in the “Contact Information” section below if you have any questions or concerns.
Third-Party Websites
MakerSights may maintain links to other websites, operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites or online services operated by third parties, and we are not responsible for the privacy practices or content of those sites. It is your responsibility to review the privacy policies of non-MakerSights websites.
Freely Given Consent and No Unjustified Detriment (GDPR-Specific Clarifications)
For individuals located in the European Economic Area (EEA), the United Kingdom, or other jurisdictions with similar consent requirements:
- Participation in AI model training and aggregated data sharing is voluntary and is not required to access the core Services.
- We do not make access to essential functions of the Services conditional on your consent to optional AI training processing.
- Refusal or withdrawal of consent will not result in unjustified detriment, such as:
- Denial of access to core Services you have already contracted for;
- Downgrading to materially inferior core service quality; or
- Higher prices solely because you exercised your rights (subject to any lawful data-driven pricing models that comply with local law).
Some features of the Services (such as access to aggregated benchmarks) may objectively require AI model training and collective data, and thus cannot be provided without participation. This limitation is based on technical necessity, not coercion. You remain free to use the core Services without opting into the optional AI training features.
We document our assessment and balancing of interests and will make a summary of our legitimate interests assessment available upon request, where required by law.
Individual Rights and Choices
Opt out of marketing communications.
You may opt out of marketing-related communications by following the opt-out or unsubscribe instructions contained in the marketing communication we sent to you, by contacting us at privacy@makersights.com or as provided in the “Contact Information” section below. You may continue to receive Services-related and other non-marketing communications.
Online tracking opt-out.
You can opt out of third-party cookies as described in our Cookie Policy. Also please note, MakerSights recognizes and honors Global Privacy Control (GPC) signals. If your browser sends a GPC signal, we will automatically treat it as a request to opt-out of the “sale” or “sharing” of your personal information for that browser.
State-Specific Privacy Rights Supplemental Notice
Scope and Applicability
This section applies solely to residents of states with comprehensive consumer privacy laws (collectively, “State Privacy Laws”). Special Notice To European Union Area, Switzerland And United Kingdom Users
The following provisions apply only to users residing in the European Union Area (EEA), Switzerland and the United Kingdom. Please note, pursuant to the EU General Data Protection Regulation (“GDPR”), we are required to provide those residing in the EEA, Switzerland and the United Kingdom (hereinafter, the “EU Users”) additional information and rights related to the Personal Data we collect about them. Purpose For Information Collection
As noted in this Privacy Policy, you may visit our Website without being required to provide us with any Personal Data. Legal Grounds For Processing Personal Data

Your Information And Your Choices; Withdrawal Of Consent
GDPR provides EU Visitors with additional rights in respect to the Personal Data we hold about you, including:

Upon appropriate written request we will update or amend your Personal Data, but we reserve the right to use any information previously obtained to verify your identity or take other actions that we believe are appropriate and lawful. You may access, correct, or request deletion of your Personal Data – or request that we stop any processing of your Personal Data - by contacting us at the address listed above. We will respond to your request within a reasonable timeframe. Certain requests – like being removed from our e-newsletter mailing list – can also be accomplished via our unsubscribe links.
We may need to retain certain information for record keeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed from such locations. Additionally, there may be circumstances in which we are not legally required to comply with your request because of the laws in your jurisdiction or because of exemptions provided in data protection legislation in general, and GDPR in particular. Finally, we are not responsible for removing or deleting information from the databases of third parties (such as service providers) with whom we have shared information about you, but we will make the request on your behalf for such removal/deletion.
Data Retention
We will retain your information for as long as needed to provide you services, or otherwise as is reasonable and customary given the nature of the relationship you have with MakerSights. We may need to retain certain information for record keeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed from such locations. Otherwise, we will retain and use your information as necessary to comply with our legal obligations, operate/promote our Site, and to foster our relationship with our users. We have a data retention and destruction plan that dictates the policies and procedures related to deletion and/or destruction of all information/data.
Children’s Privacy/Note To Parents Of Children Residing In The EU, Switzerland And UK
We do not intentionally or knowingly collect, use, or disclose personally identifiable information about EU Visitors to our Site that are less than 16 years of age. If a child under the age of 16 submits information to us through any part of the Website and MakerSights becomes aware that the user submitting the information is under the age of 16, the information provided will be deleted as soon as it is discovered and not used for any purpose. If you are the parent or guardian of a child under 16 years of age and believe that they have disclosed personally identifiable information to us, please contact us, and please include in your message the same name and email address that you believe your child submitted, if applicable.
Data Privacy Framework/Complaints
MakerSights complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, as set forth by the U.S. Department of Commerce. MakerSights has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of Personal Data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles, the Principles shall govern.
